These Customer Terms & Conditions ("Terms") govern your access to and use of the 404Eats website, mobile applications, and related services (collectively, the "Platform"). By creating an account, accessing the Platform, or placing an order, you agree to these Terms.

1. About 404Eats

404Eats is an online marketplace that connects customers with independent restaurants offering delivery, pickup, and reservation services. Restaurants are independently owned and operated and are solely responsible for their food, pricing, preparation, quality, and compliance with applicable laws.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to use the Platform.

3. Your Account

You agree to provide accurate and current information when creating an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity occurring under your account.
• Promptly notifying us of any unauthorized use.

4. Orders

By placing an order, you authorize payment for all applicable charges, including food, taxes, delivery fees, service fees, and optional tips.

Restaurants may refuse or cancel orders based on availability or operational reasons.

Once a restaurant begins preparing your order, it generally cannot be canceled unless required by applicable law.

5. Delivery & Pickup

Estimated delivery times are estimates only and are not guaranteed.

Customers are responsible for:

• Providing an accurate delivery address.
• Being available to receive deliveries.
• Picking up pickup orders within a reasonable time.

404Eats is not responsible for delays caused by weather, traffic, restaurant operations, or circumstances beyond our reasonable control.

6. Restaurant Reservations

404Eats offers reservation services for participating restaurants.

Reservation availability is determined solely by the restaurant. Restaurants may modify or cancel reservations due to operational needs.

7. Payments

Payments are processed through secure third-party payment processors.

You authorize the applicable payment processor to charge your selected payment method for all amounts due.

If payment cannot be completed, your order may be canceled.

8. Refunds

Refund requests are reviewed individually.

Refunds may be available for:

• Incorrect orders
• Missing items
• Duplicate charges
• Orders that cannot be fulfilled
• Significant food quality or safety concerns

Refunds are generally not provided for:

• Personal taste preferences
• Minor delivery delays
• Partially consumed food, except where required by law

9. Promotions & Discounts

Coupons, promotional codes, and rewards:

• Have no cash value.
• May expire without notice.
• May not be combined unless expressly stated.
• May be revoked if misused or obtained fraudulently.

10. User Conduct

You agree not to:

• Submit fraudulent orders.
• Abuse promotions or referral programs.
• Harass restaurants, delivery personnel, or other users.
• Attempt unauthorized access to the Platform.
• Upload malicious software or interfere with Platform operations.
• Violate any applicable law.

404Eats may suspend or terminate accounts that violate these Terms.

11. Reviews & User Content

You may submit ratings, reviews, photographs, and other content.

You are responsible for ensuring your content is lawful, accurate, and does not infringe on the rights of others.

By submitting content, you grant 404Eats a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with operating and promoting the Platform.

12. Intellectual Property

All Platform content, including trademarks, logos, software, graphics, text, and images, is owned by or licensed to 404Eats and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, or commercially exploit any content without prior written permission.

13. Third-Party Services

The Platform may use third-party services, including payment processors, mapping providers, and communication services.

404Eats is not responsible for the products, services, or policies of third parties.

14. Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, 404Eats disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, 404Eats shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim relating to a specific order shall not exceed the amount paid for that order.

Nothing in these Terms limits liability that cannot legally be excluded.

16. Indemnification

You agree to indemnify and hold harmless 404Eats, its affiliates, officers, employees, and service providers from claims, damages, losses, and expenses arising from your misuse of the Platform or violation of these Terms.

Your use of the Platform is also governed by the 404Eats Privacy Policy, which explains how we collect, use, disclose, and protect your personal information.

19. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, except where applicable law requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
